1. INTRODUCTION

These terms and conditions of use, together with our privacy policy, any end-user licence agreements for authorised software and other digital downloads (“EULA”), and all supplemental terms (as amended from time to time) and other documents and policies expressly referenced in these terms and conditions (the “Terms”), govern your use of any Artful Games Product(s) (as defined below) made available by Artful Games to you (“you”/“your”).

The Artful Games Product is made available to you in accordance with these Terms by Crescent Marketing Limited (“Artful Games”, “we”, “our”, “us”), a company registered in United Kingdom 13902053, whose registered office is Bedford Heights, Brickhill Drive, Bedford, Bedfordshire, England, MK41 7PH.

Please read these Terms carefully. These Terms form a legally binding contract between you and us. By downloading, browsing, installing, accessing or using a Artful Games Product in any way, you agree to be bound by these Terms. If you do not agree, you should not create an account (“Account”) or download, install, browse, use or access the Artful Games Product. If you have already created an Account or downloaded/used a Artful Games Product and do not agree to these Terms, you should immediately discontinue use, cancel your Account, and uninstall any related software.

If you use a Artful Games Product via a third-party platform (e.g., Apple App Store or Google Play), these Terms apply in addition to any terms imposed by that platform.

PLEASE KEEP A COPY OF THESE TERMS FOR FUTURE REFERENCE. YOU SHOULD CHECK THESE TERMS EACH TIME YOU USE A Artful Games PRODUCT, AS WE MAY CHANGE THEM IN ACCORDANCE WITH SECTION 6.

2. DEFINITIONS

“Artful Games Product(s)” means the applicable mobile and online versions of our digital product offerings (including artfulgames.net), as we may make available to you from time to time, and includes any authorised software needed to operate these games, video and other digital content and access the platforms; all updates, additional content and localised versions; and any related products, websites, applications or services made available by Artful Games. THE ONGOING SUPPLY OF ANY PARTICULAR Artful Games PRODUCT IS NOT GUARANTEED. Artful Games PRODUCTS HAVE AGE RESTRICTIONS.

References to “Stop” or “Stopping” an Account include temporarily or permanently disabling, suspending, banning or muting an Account. If your Account is muted, you can continue to access content but cannot post ratings or feedback. If your Account is disabled or banned, you will not be able to access your Account and any licences previously granted to you to use the Artful Games Products may be temporarily or permanently revoked. THIS MEANS YOU MAY LOSE YOUR ACCOUNT, CHARACTERS AND ANY IN-GAME ITEMS OR PURCHASES. More information about when Artful Games may Stop your Account is set out in Section 4 below.

“Subscriber” means a user who pays a fee to obtain subscription-based access to features of a Artful Games Product. See Section 5.

“User Content” means all information of any kind (including remarks, suggestions, ideas, graphics, text, images, video, information and messages) communicated, posted, uploaded or sent by users (whether Subscribers or not) on or in connection with Artful Games Products (including any content created in-product such as a character’s appearance).

Other capitalised terms are defined in context below.

3. AGE RESTRICTIONS

Artful Games Products have age restrictions prohibiting users under 18 from creating an Account. You must not create an Account or use a Artful Games Product if you are under 18, and it is a breach of these Terms to register an Account on behalf of someone under 18. Where a relevant age-rating body (e.g., PEGI, ESRB, USK) or platform (e.g., Apple, Google Play) classifies a Product as suitable only for users above a specified age (above 13), users below that age must not play, use or access that Product until they reach the specified age classification. We do not knowingly collect or store personal data from children under 18. If we discover such data, we will Stop the Account.

Parents/guardians are responsible for preventing access by children under 18 and should use parental controls. If a parent/guardian informs us that a child has misrepresented their age and accessed a Artful Games Product, we will Stop the Account once we verify the report.

4. YOUR ACCOUNT AND LICENCE

Many features require an Account and, for some platforms, authorised software on your device. We grant valid Account holders a non-exclusive, non-transferable, non-sub-licensable, personal, limited licence (revocable at any time) to access and use Artful Games Products and to download/install authorised software to connect to our servers solely for personal, non-commercial purposes, subject to strict compliance with these Terms.

You must not decompile, reverse engineer, copy, reproduce, transmit, publicly perform, distribute, commercially exploit, adapt, translate, modify, bundle, merge, share, create derivative works of or otherwise misuse any Artful Games Product or software. You must not use automation tools, macros or bots; share/sell/buy Accounts; engage in real-world trading; use multiple Accounts to circumvent these Terms; exploit bugs; impersonate our staff; solicit Account details; run games of chance in or using the Product; encourage others to breach these Terms; use inappropriate language/behaviour (including offensive, racist, obscene or discriminatory conduct); request personal details of other users; or advertise third-party websites in a Product, forum or social channel.

Except as expressly provided, use of a Artful Games Product does not grant you any right, title, interest or licence to any intellectual property you access. THE Artful Games PRODUCTS AND ANY ASSOCIATED SOFTWARE ARE LICENSED TO YOU, NOT SOLD. YOUR LICENCE CONFERS NO TITLE OR OWNERSHIP.

Usernames must not infringe third-party rights, impersonate staff or users, be deliberately confusing, offensive, racist, obscene, unlawful or otherwise inappropriate. We may change any username at our sole discretion.

Keep your password secure. You are fully responsible for activities on your Account and for complying with licence terms. You are expressly prohibited from allowing anyone else to use your Account. We may Stop your Account if someone else uses it.

We do not guarantee Artful Games Products are secure or bug-free. You must not attempt unauthorised access to a Product, server, computer or database or carry out denial-of-service attacks. We may report breaches to law enforcement.

If you believe someone has accessed your Account or device without permission, submit an Account recovery request via Customer Support. You remain responsible for your Account until you notify us.

5. PAYMENTS, SUBSCRIPTIONS AND CANCELLATIONS

By agreeing to these Terms, you represent that you are the authorised user of any payment method you provide or use in connection with any Artful Games Product, including (without limitation) any card details, PINs, or Account credentials, and you authorise Artful Games to charge such method directly or via the relevant payment processor for amounts payable by you.

Artful Games may require your address or other personal information to meet tax obligations. You represent that such information is accurate and up-to-date and that you will not use IP proxying or similar methods to disguise your residence to circumvent geographical restrictions or pricing. If you do, we may terminate your access.

Certain features require an active subscription. If you subscribe, you must ensure all submitted information is true and accurate (including your card number, expiry date and other payment details) and that you are at least 18 years of age. You agree to pay all subscription fees specified at checkout, including applicable taxes. Unless stated otherwise, prices for UK and EU customers include VAT where applicable.

By submitting your order you are making an offer to subscribe. Your offer is accepted and a binding contract occurs when (i) we send a message to your Account inbox confirming receipt of payment; or (ii) you log into a Subscribers-only part of a Artful Games Product (whichever occurs first).

Artful Games will not be liable for sales or use taxes you may be subject to. If such taxes are payable, we may charge them in addition to subscription and other fees.

PAYING BY CARD

You can start a recurring subscription using a credit or debit card. There is no minimum term: payments will be taken monthly until you cancel your subscription, or if your Account is permanently banned for breach of these Terms. The cost of memberships depends on the plan you choose and current exchange rates.

Our available membership plans:

  • Complete Access + News — $49.99/month (recurring): Unlimited access to all available content at sign-up, plus a live news feed.
  • Complete Access — $39.99/month (recurring): Full content access available at the time you join.
  • Partial Access + News — $29.99/month (recurring): Access to half the site’s content plus live news updates.
  • Partial Access — $19.99/month (recurring): Access to half the content library at sign-up.
  • 12 Day Access — $12.99 (one-off): 12 days of complete access.
  • 10 Day Access — $10.99 (one-off): 10 days of full access.
  • 9 Day Access — $9.99 (one-off): 9 days of full access.
  • 8 Day Access — $8.99 (one-off): 8 days of full access.
  • 6 Day Access — $6.99 (one-off): 6 days of full access.
  • 4 Day Access — $4.99 (one-off): 4 days of full access.
  • 3 Day Access — $2.99 (one-off): 3 days of full access.
  • 1 Day Access — $1.95 (one-off): 1 day of full access.

*Recurring memberships renew monthly until cancelled. Charges apply at purchase and then monthly thereafter.

We accept Visa and Mastercard globally, and PayPal in some countries. Certain gift/prepaid cards may be used if they support overseas and online payments.

Our websites use industry-standard SSL encryption to help keep your payment details secure.

We charge your card at the end of each subscription period. The subscription period is indicated at purchase. If you wish to cancel, please do so at least two days before the end of your billing term to avoid further charges.

To update your card or contact details, contact Customer Support.

When you subscribe, you agree that:

  • Your subscription offer is accepted when we confirm receipt of payment or when you log into a Subscribers-only area (whichever occurs first).
  • All subscription payments will continue to be taken in advance at the relevant intervals (e.g., monthly) until you cancel.
  • Payments by card are also subject to our cardholder terms, which form part of these Terms.

You are agreeing to an automatic recurring debit of funds from your card or PayPal account at the interval defined in the subscription terms. We will not request separate authorisation before each payment. Payment will be taken once per billing cycle.

Payments will be taken only within the terms of this agreement. You may cancel at any time, but billing will continue until you cancel.

ALL SUBSCRIPTION PAYMENTS WILL CONTINUE TO BE TAKEN IN ADVANCE AT THE RELEVANT INTERVALS (INCLUDING, WHERE INDICATED AND AGREED, MONTHLY FOLLOWING AN INITIAL PROMOTIONAL PERIOD) UNTIL YOU CANCEL YOUR SUBSCRIPTION. RENEWAL PAYMENTS MAY BE TAKEN UP TO 3 DAYS BEFORE YOUR CURRENT SUBSCRIPTION PERIOD ENDS.

We reserve the right to alter subscription amounts or terms at any time. Changes apply to new or renewed subscriptions where you expressly agree to the new fees/terms. Existing Subscribers whose subscriptions have not expired, terminated or changed in nature/type will not be bound by later changes until they re-subscribe or alter their plan.

You are responsible for any unauthorised use of your subscription by third parties.

CANCELLING YOUR SUBSCRIPTION

You may cancel at any time via the Customer Support section of the Artful Games Product. Upon cancellation you will not be charged further subscription fees. Payments already made (including for any unused period) are non-refundable unless required by law, but you may use any remaining subscription credit on your Account.

6. INDIVIDUAL PURCHASE GAMES & DIGITAL ITEMS

In certain Artful Games Products, you may be offered a licence (or, at our discretion, granted a promotional licence) to access individual games or other digital items—such as videos, movies, audiobooks and similar—for individual purchase. These are offered only to Accounts with an active paid Subscription. We are legally bound to provide such a licence only if we (or our third-party operators) notify you of acceptance of your purchase and once the item is made available within the Artful Games Product.

When you obtain Individual Digital Items from us or authorised partners, you receive a personal, limited, non-transferable, non-sub-licensable, non-exclusive, revocable licence to access the rights and entitlements expressly made available with that item and only in the applicable Artful Games Product. Items are licensed, not sold. Any licence is subject to your strict compliance with these Terms and maintenance of an active paid Subscription.

PLEASE NOTE THESE IMPORTANT RESTRICTIONS:

Individual Digital Items may expire if not redeemed or used within a specified period after acquisition, as stated on the payment page at the time of purchase.

WE MAY AT ANY TIME, AT OUR SOLE DISCRETION, CHANGE OR REMOVE ANY ITEM AVAILABLE FOR INDIVIDUAL ACQUISITION AND/OR CHANGE ITS PRICE.

7. RIGHT OF WITHDRAWAL (UK CONSUMERS)

If you are a UK consumer, you may have a right to cancel this contract within 14 days without giving reasons under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

The cancellation period is 14 days from the day the contract is concluded.

To exercise your right of withdrawal, visit the Support section of our website (https://artfulgames.net/account/) and provide your name, artfulgames.net username (if any) and email address. If you cancel online, we will acknowledge receipt by email.

Effects of cancellation. If you cancel, we will refund all payments received from you, including standard delivery costs (if any), without undue delay and no later than 14 days from the day we receive your cancellation notice. We will make the refund using the same payment method you used, unless agreed otherwise; you will not incur fees for the refund.

Exception for digital content. You cannot cancel an order for digital content once delivery has begun with your express consent and your acknowledgement that you thereby lose your right to cancel.

8. REFUND POLICY

We will consider refund requests on a case-by-case basis.

Unless required by law, we will not refund amounts paid for Subscriptions or Individual Digital Items where:

  • You have been the victim of scamming (we warn about avoiding scams and will try to assist with Account recovery).
  • You have been Stopped for violating these Terms or applicable rules.
  • You have used unauthorised software to access a Artful Games Product.
  • Artful Games stops offering the relevant Product.
  • You decide to cancel your subscription or Account.

If you still wish to request a refund, please contact Customer Support via the applicable website with as much detail as possible. Refunds are at Artful Games’s sole discretion (your statutory rights remain unaffected).

9. CHANGES TO THESE TERMS

We may change these Terms to reflect: (a) changes in applicable laws; (b) regulatory or security requirements; (c) relevant guidance or codes of practice; (d) technical changes to Artful Games Products; (e) clarity and consistency improvements; or (f) any other reason at our sole discretion.

Please check the Terms whenever you use a Artful Games Product. Your continued use after changes take effect constitutes acceptance. If you do not agree, you should cancel your Account and, if applicable, your subscription before its renewal date.

10. SAFETY AND ABUSE

User Content may be inaccurate, out of date or otherwise inappropriate. We cannot guarantee users will comply with our Terms, rules or behave appropriately. Do not assume a user is who they claim to be and do not attempt to contact any user outside a Artful Games Product.

Report offensive or inappropriate behaviour to Customer Support. If issues persist, stop using the relevant Product.

11. USER CONTENT

You are responsible for the legality, reliability, appropriateness and originality of your User Content and for compliance with all applicable laws and regulations.

We may, without notice or refund, monitor, record, suspend, remove or delete User Content and/or suspend or permanently disable your Account, or disclose User Content to authorities if: (a) it is the subject of a complaint; (b) we consider or suspect it breaches these Terms (including our content standards) or Product rules; (c) we consider such steps necessary to protect us or others; (d) a criminal act or civil wrong has been committed; or (e) required by law or authority.

To report allegedly infringing or unlawful User Content, contact Customer Support with: (1) your contact details (full name, player name if applicable, postal address, telephone number, email); (2) details of the material and reasons for complaint; (3) the exact URL/location and a screenshot; and (4) where relevant, proof of rights and a statement (on penalty of perjury) that you are the rights holder or authorised representative.

Removing your User Content from public display may not ensure its complete deletion.

12. CONTENT STANDARDS POLICY

You must ensure all User Content complies with this section and any Product-specific policies on Artful Games websites or platforms.

User Content must:

  • be accurate, complete, submitted in good faith and compliant with all applicable laws, regulations and codes of conduct; and
  • be uploaded only if you own the rights, have permission from the rights holder, or are otherwise authorised by law.

User Content must not:

  • be obscene, hateful, inflammatory, threatening, intentionally misleading, harassing, sexually explicit, deceptive or fraudulent;
  • promote violence or discrimination; endorse illegal activity; or be otherwise objectionable;
  • be defamatory or invade privacy;
  • infringe third-party rights (including copyright, trademarks, database rights, confidentiality);
  • spread false or misleading information;
  • impersonate any person or misrepresent your identity/affiliation;
  • include hyperlinks to third-party websites (unless expressly permitted);
  • contain viruses, Trojans, worms, time-bombs, key-loggers, spyware, adware or other harmful code;
  • reveal details enabling identification or contact outside the Product (e.g., surname, postal/email address, telephone number);
  • have a commercial purpose; involve spam, junk mail, pyramid schemes or similar; or
  • otherwise breach the spirit or intention of these standards.

By submitting material to us for any purpose connected with a Artful Games Product (e.g., suggestions, gallery contributions), you grant us a non-exclusive, perpetual, irrevocable, transferable, sub-licensable, worldwide, royalty-free licence to use, modify, copy, publicly perform, display, reformat, translate, excerpt, publish and distribute such User Content for any purpose, provided we do not use it in violation of our Privacy Policy. You waive any moral rights to the extent permitted by law and warrant you are the exclusive rights holder or have authority to grant the above rights.

Any User Content you upload will be considered non-confidential and non-proprietary. You warrant it is your original content, contains no third-party personal data, and that you have all necessary rights and consents.

You acknowledge you have no ownership or proprietary interest in a Artful Games Product or in User Content that incorporates Artful Games intellectual property.

13. INTELLECTUAL PROPERTY RIGHTS, OWNERSHIP AND RESTRICTIONS

“Artful Games” and other trade names are trademarks (registered and/or unregistered) of Crescent Marketing Limited in United Kingdom, the United Kingdom, the United States and other countries. Names, brands and logos of other video games and digital content published by Artful Games are owned by Crescent Marketing Limited or third parties and used under licence.

You must not create or provide any means by which a Artful Games Product may be played or viewed by others (including modified client/server software or server emulators). Such activity may constitute civil and/or criminal offences.

Materials placed on any Artful Games Product by us (or on our behalf) are protected by copyright and other intellectual property rights. You may use them only in accordance with these Terms and for personal, non-commercial use.

You acknowledge that all intellectual property and other rights in any Artful Games Product—including any character, Account, content, video, game and other digital items—are and will remain the property of Crescent Marketing Limited and/or its licensors. As part of the licence granted under these Terms, you are only granted limited, non-transferable, non-sub-licensable permission (revocable at any time) to use such content or Product for personal, non-commercial use.

NOTWITHSTANDING ANYTHING TO THE CONTRARY, YOU ACKNOWLEDGE AND AGREE THAT YOU HAVE NO OWNERSHIP, TITLE OR OTHER PROPRIETARY INTEREST IN ANY Artful Games PRODUCT OR ACCOUNT, AND THAT ALL RIGHTS IN AND TO AN ACCOUNT ARE AND SHALL FOREVER BE OWNED BY, AND INURE TO THE BENEFIT OF, Artful Games. We do not permit: (a) transfers of digital items outside Product rules; (b) transfers of Accounts; or (c) sale, gift or trade in the real world of anything that appears in a Artful Games Product.

We may stop offering a Product or any part of it at any time, permanently or temporarily, at which point any licence to use the Product or part of it will be terminated or suspended and your Account may be Stopped. In such event, we are not required to provide refunds, benefits or other compensation unless required by law.

14. STOPPING YOUR Artful Games ACCOUNT

If, acting reasonably, we consider that: (1) these Terms or Product rules have been, may be, or will be breached; and/or (2) there has been fraudulent, unlawful or abusive activity; and/or (3) it is necessary to prevent or stop harm or damage to us, to a Product, to other users, the public or to you (e.g., where we believe you are spending an excessive amount of money), then we may, at any time, in our sole discretion: (i) Stop any or all of your Accounts; (ii) restrict access to any feature; and/or (iii) restrict access to or delete content you have acquired. These actions may result in loss of real money paid in prohibited transactions (e.g., Account trading). You may have a right of appeal.

WE DO NOT GUARANTEE THE ONGOING SUPPLY OF ANY Artful Games PRODUCT OR THAT A PRODUCT AND RELATED SERVICES/CONTENT WILL BE AVAILABLE AT ALL TIMES, IN ALL LOCATIONS, OR FOR ANY GIVEN PERIOD. UPON REASONABLE NOTICE TO YOU (AND WITHOUT REASON), Artful Games MAY STOP ANY ACCOUNT. YOU ACKNOWLEDGE THAT YOU ARE NOT ENTITLED TO ANY REFUND FOR AMOUNTS PAID IN CONNECTION WITH THE ACCOUNT, UNLESS REQUIRED BY LAW.

15. NO GAMBLING

The Artful Games Products and services are provided strictly for entertainment purposes only. They do not constitute gambling services under the Gambling Act 2005. We do not offer real-money wagering, staking, lotteries or prize-winning opportunities of monetary value.

Any casino-themed, lottery-style or chance-based games or features within the Artful Games Products are purely simulated. They do not provide opportunities to win real money, goods or items of monetary value and must not be interpreted as gambling or betting activity. Virtual items and outcomes have no cash value and cannot be exchanged for real-world money or assets.

16. FUNCTIONING OF Artful Games PRODUCTS

We will use reasonable endeavours to maintain operation of Artful Games Products and rectify faults promptly. We may modify Products (including via updates) and may need to suspend operation without notice for repair, maintenance, improvement, security or other reasons. We cannot accept responsibility for suspensions, interruptions or errors caused by circumstances outside our reasonable control.

Third-Party Software. Some Products require additional “client software”. Alternative third-party software may exist. We do not recommend, endorse or authorise the use of third-party software and it will not be available for download on Artful Games websites. Use is at your own risk. We give no warranties for such software and may restrict access where it is used. We may require all users to use only authorised client software, giving reasonable notice where practicable.

We do not guarantee a Product will work on or be compatible with any particular devices, platforms, operating systems or equipment, or with non-authorised software or services, nor that it can be accessed in all geographic locations. Minimum technical specifications and compatibility information may be available on Product websites.

We cannot guarantee the ongoing supply of any particular Artful Games Product.

17. THIRD-PARTY SITES AND TECHNOLOGIES

Artful Games Products may include links to third-party sites or technologies (including payment methods provided by third parties). We are not responsible for their content, products, services or their collection/use/disclosure of personal information. Suggested technologies are not endorsed, controlled or verified by us and may not be virus-free or compatible. To the maximum extent allowed by law, we disclaim liability for loss or damage caused by your access to any third-party sites or technologies.

18. OUR AND YOUR LEGAL RESPONSIBILITY (LIMITATION OF LIABILITY)

Artful Games Products are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, we provide no express, implied or statutory warranties that you will be able to access or use a Product at times or locations of your choosing or that a Product will be uninterrupted or free of errors, bugs, corruption, loss, interference, hacking or viruses.

To the maximum extent permissible by law, our total aggregate liability to you, whether in contract, tort (including negligence), strict liability or otherwise, including for any losses, costs, expenses or damages suffered in connection with a Artful Games Product or these Terms, shall not exceed the amount of subscription fees actually paid by you to Artful Games for the relevant Product in the twelve (12) months prior to the date the cause of action first arose. Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence or for fraud/fraudulent misrepresentation.

We provide Products for personal use only. You agree not to use them for commercial or business purposes, and we have no liability for loss of profit, loss of business, business interruption, loss of business opportunity or any indirect or consequential loss. Nothing in these Terms affects your statutory rights as a consumer.

You will be liable for any loss or damage we suffer arising from your breach of these Terms or misuse of a Product.

19. HOW WE MAY USE YOUR PERSONAL INFORMATION

We will use your personal data as set out in our Privacy Policy.

20. LINKING TO Artful Games PRODUCTS

You may link to our home page or to a Product page within a third-party app store or site, provided you do so in a way that is fair and legal and does not damage our reputation or take unfair advantage of it.

You must not establish a link in a way that suggests association, approval or endorsement on our part where none exists. We may withdraw linking permission without notice. If you wish to link to or make any use of content other than as set out above, please contact us.

21. COMPLAINTS

If you are dissatisfied with a Artful Games Product or any aspect of it, please contact us via the Customer Support section of the website or app. If you remain unhappy with the outcome, you may write to our registered office (see Contact Details) with: your name, username, email address, full details of your complaint, our previous response, and why you disagree. Mark correspondence for the attention of Customer Support – Complaint.

22. DISPUTE RESOLUTION

If you have a question or complaint, you must first contact our Customer Support team so we can try to resolve it informally.

If your issue is not resolved through Customer Support, you are required to participate in an independent alternative dispute resolution (ADR) procedure in accordance with the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015. We will provide you with details of an ADR entity that is competent and, where applicable, approved or certified for the relevant sector. You may also use any other ADR entity that is competent to deal with your complaint.

Only after the ADR procedure has concluded may either party bring a claim before the courts of England and Wales. Nothing in this section affects any non-waivable statutory right to bring a claim in court; however, you must first exhaust the Customer Support process and the ADR procedure described above.

23. ASSIGNMENT

We may transfer, assign, delegate or subcontract any or all of our rights and obligations under these Terms, in whole or in part, to any affiliate, successor, acquirer of our business, or to any third-party or third-parties, without restriction and without notice to you.

You acknowledge and agree that you may not transfer, assign, charge or otherwise dispose of any of your rights or obligations under these Terms under any circumstances. Any attempt by you to do so shall be void and of no effect.

24. SURVIVABILITY

The following provisions of these Terms shall survive termination, cancellation or expiry of your Account or these Terms for any reason: Intellectual Property Rights, Ownership and Restrictions; Payments, Subscriptions and Cancellations (to the extent of outstanding amounts and billing effects of cancellation); Refund Policy; Stopping Your Account; Functioning of Products (to the extent applicable); Third-Party Sites and Technologies; Our and Your Legal Responsibility (Limitation of Liability); How We May Use Your Personal Information; Dispute Resolution; Assignment; Survivability; Force Majeure; Complaints; Right of Withdrawal (to the extent applicable to past purchases); and No Gambling. Any other provisions which by their nature are intended to survive shall also continue in full force and effect.

25. FORCE MAJEURE

“Force majeure” means any cause or event beyond the reasonable control of the affected party, including without limitation war, civil war, armed conflict or terrorist attack; nuclear, chemical or biological contamination; pandemic; strikes; industrial action; unavailability of the internet; unscheduled hosting or systems maintenance; power or data losses; and acts of God. We are not obliged to perform our obligations to the extent we are prevented from doing so by a force majeure event. Performance may cease during the event and for such time after it ceases as is reasonably necessary to resume. If force majeure continues for over four months, we may terminate access to Artful Games Products immediately by notice.

27. GOVERNING LAW AND JURISDICTION

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. Subject to the requirement to follow the Dispute Resolution process in Section 21, the courts of England and Wales shall have exclusive jurisdiction.
